Ex-Senator Wins Landmark Defamation Case in Australia

A former Australian senator has won a defamation programme against a former worker to accuse her of trying to cover up an allegation of being raped at work.

This case involved Linda Reynolds, who was a plaintiff in a case that was related to allegations given by Brittany Higgins in 2021. Higgins said she was raped by a fellow employee at Parliament House and said Reynolds, her employer at the time, had attempted to silence her. Reynolds then sued Higgins in 2023, citing very significant damage to her reputation and health because of Higgins’ social media posts.

In November 2003, after a five-week trial in the Supreme Court of Western Australia, the court held in Reynolds’ favor and awarded her damages of AU$315,000, plus interest.

The court declared that out of the three social media posts made by Higgins, two of them were defamatory. One was an Instagram story in July 2023, accusing Reynolds of mishandling the rape claim. The other was a tweet stating that Reynolds did not want Higgins to report the incident to the police and that she is a hypocrite in gender advocacy.

In ruling that the defamatory posts were not fair comment, Justice Paul Tottle wrote that they passed beyond the limit of fair comment. The judge decided that Higgins’ accusations had an unfair effect on the personal and business life of Reynolds, who experienced a lot of emotional and physical tension.

The judge, though, disregarded the claim of Reynolds that Higgins and her partner, David Sharaz, had been planning to calumniate her. Ruling out an injunction requested by the senator to prevent Higgins from commenting on the issue even in the future, he also gave a timely verdict on the case, stating that even though there was nothing illegal in participating in the race, the senator should have clarified his position on the protests at the time of the race.

What kind of effect has the Case Had On the People Involved?

The court challenge comes after a long period of scrutiny of the initial rape allegation. The criminal trial against the accused, Bruce Lehrmann, was later abandoned in 2022, after a jury was found to have behaved improperly, but a civil court later ruled in 2024 that it was more likely than not that Lehrmann raped Higgins and lied about it. Lehrmann is appealing that decision.

He said that the event that occurred upon the verdict of the defamation case vindicated Reynolds and showed her intent to tell on truth.
